CONFIDENTIALITY POLICY

At Bharat e-Filing, we place a major emphasis on maintaining the confidentiality of client information and ensuring robust Information Security Management. The following key points outline our commitment to client confidentiality, which applies to all our clients:

  • We do not disclose any information related to our clients to third parties.
  • We do not use our clients’ identity or brand for marketing purposes without their explicit written consent.
  • We do not share client names or information with prospective clients for marketing or reference purposes.
  • We do not sell, trade, or disclose our client list or client information to any third parties.

CONFIDENTIALITY AGREEMENT

It is understood and agreed that a Bharat e-Filing client may provide certain information that must remain confidential. To protect such sensitive information and comply with applicable patent and trade secret laws, the following terms shall apply:

  • The Confidential Informationmay include, but is not limited to: invention details, technical and business data, proprietary concepts, patentable ideas, trade secrets, diagrams, research material, development plans, cost and profit data, financial projections, customer and client information, marketing strategies, and current or future business plans—regardless of whether the information is explicitly marked as “Confidential Information” at the time of sharing.
  • Bharat e-Filingshall limit access to such Confidential Information within its own organization to only those directors, officers, partners, employees, or independent contractors (collectively referred to as “affiliates”) who require access for work purposes. Bharat e-Filing and its affiliates will not disclose this information unless legally required to do so.
  • This Agreement does not apply to any Confidential Information that:
  • (a) Was already in Bharat e-Filing’s possession prior to being provided by the client;
  • (b) Becomes publicly known through no fault of Bharat e-Filing;
  • (c) Is lawfully received from a third party not under any confidentiality obligation;
  • (d) Is disclosed to a third party by or with the client’s authorization without restriction;
  • (e) Is already available in the public domain; or
  • (f) Is independently developed by Bharat e-Filing without reference to the client’s information.
    • This Agreement represents the entire understandingbetween Bharat e-Filing and the client concerning the protection and use of Confidential Information. Any amendments or additions must be made in writing and signed by both parties.
    • If any part of this Agreement is found to be unenforceable, the remaining provisions will remain valid and enforceable to the fullest extent possible. The unenforceable part shall be modified only to the extent required to make the entire Agreement enforceable.
    • YOU ARE SOLELY RESPONSIBLE FOR ANY CONSEQUENCES, LOSSES, OR DAMAGES THAT BHARAT E-FILING MAY INCUR OR SUFFER—DIRECTLY OR INDIRECTLY—AS A RESULT OF ANY UNAUTHORIZED ACTIVITIES CONDUCTED BY YOU, AND SUCH ACTIONS MAY RESULT IN CIVIL OR CRIMINAL LIABILITY.
